พระราชบัญญัตินี้ไม่ให้ใช้บังคับแก่
(๑) การประกอบธุรกิจแฟรนไชส์ซึ่งแฟรนไชส์ซอร์มีภูมิลำเนาและทำสัญญานอกราชอาณาจักรเพื่อให้สิทธิแฟรนไชส์ซีเข้ามาประกอบธุรกิจที่ได้รับสิทธินั้นในราชอาณาจักรด้วยตนเอง
(๒) การประกอบธุรกิจแฟรนไชส์ตามที่รัฐมนตรีประกาศกำหนด
